Is 180-182 Parker Ave rent-controlled?

Statewide backstop · AB 1482

California Tenant Protection Act of 2019

Even when a building isn't covered by local rent stabilization, the statewide Tenant Protection Act (AB 1482) may still apply. It caps annual rent increases and requires the landlord to state a legal reason to end most tenancies.

Built 1935
Annual rent increase cap
5% + CPI, max 10%
Just-cause eviction
After 12 months
Local rent control likely takes priority. This building appears to fall under the local ordinance above, which is stronger than AB 1482. Where a local just-cause ordinance applies, its rules govern instead of the state cap.

AB 1482 does not apply to single-family homes and condos unless owned by a corporation, REIT, or an LLC with a corporate member; to owner-occupied duplexes; or to deed-restricted affordable housing. The Act is in effect until January 1, 2030. Not legal advice — see the California landlord–tenant guide.

Initial analysis

The property at 180-182 Parker Avenue is a three-story, two-unit multi-family residential building located in the Jordan Park/Laurel Heights neighborhood, owned by Lo Kit and constructed in 1935. The building has undergone significant renovations over the past decade, with the most substantial work completed between 2013-2019, including a comprehensive interior remodel of both units, kitchen upgrades, bathroom additions, and HVAC system improvements. In 2019, substantial work was performed including kitchen remodels, bathroom additions, and electrical upgrades with a total cost of approximately $55,000. The building received a new roof in 2022, costing $12,500. Several window-related projects were carried out in 2015, including the replacement of windows and garage doors with wood clad windows, though these works led to a building violation regarding unauthorized door installation in place of a window, which was eventually resolved in 2016.

The property has a history of addressing maintenance and safety requirements, including furnace replacements in 2014 (with one system rated at 95% efficiency), and comprehensive electrical upgrades including the installation of new service panels and safety systems. Prior to 2016, the building faced some violations related to lead paint hazards and exterior maintenance, primarily from 2009-2015, though these were subsequently abated. The building was also involved in a short-term rental complaint that was resolved in accordance with city regulations. Recent activity around the property has primarily consisted of routine municipal services such as street cleaning and parking enforcement, with several reports of human/animal waste and parking violations in the vicinity since 2019, though these are external to the building itself.

I do not know if this address is registered with the OSTR but I see many different parties entering and leaving this property with luggage. Though this has been going on for several years, there has been an uptick of parties entering and leaving this summer. Also, I do not believe the ‘host’ actually lives on the property. We just learned they're renting out 3 total units. The first and third floor are short-term rentals. The second floor is allegedly rented out to new long-term tenants that seemed to have just moved in. There were many short-term tenants on the second floor before.
