Texas Data Privacy and Security Act Notice

Section 1: TDPSA APPLICABILITY TO AUGRENTED

1.1 Threshold Requirements

Texas Business & Commerce Code § 541.002(a) provides that Chapter 541 applies only to a person that:

• Conducts business in Texas or produces a product or service consumed by Texas residents;
• Processes or engages in the sale of personal data; and
• Is not a small business as defined by the United States Small Business Administration, except to the extent Section 541.107 (governing the sale of sensitive data) applies to a small business.

1.2 Augrented Is a Small Business Under the SBA Standard, and Does Not Sell Personal Data

Augrented is a small business as defined by the United States Small Business Administration's size standards. Because Chapter 541's third threshold excludes small businesses from the statute's general obligations, Augrented is not a "controller" subject to Chapter 541's general requirements — data protection assessments, purpose/processing limitations, consumer rights request procedures, and related controller obligations do not apply to Augrented.

Separately, and independent of the small-business exclusion, Augrented does not sell personal data of any kind — sensitive or otherwise — to any third party. Section 541.002(a)(2)'s trigger for the sale of personal data is accordingly not implicated by Augrented's practices in the first place.

The sole exception preserved for small businesses is Section 541.107, which governs the sale of sensitive personal data. As just noted, Augrented does not sell sensitive personal data to any third party, so Section 541.107's opt-in consent requirement is satisfied by that fact: there is no sale for it to regulate. See Section 4 below.

Section 2: PROPERTY DATA AND THE TDPSA

2.1 Augrented Does Not Publish Personal Data on Property Owners

Augrented's platform displays information about properties and buildings — including ownership registration records, building characteristics, violation histories, and inspection data — sourced from publicly available government records. Augrented does not publish personal data about property owners in the sense contemplated by the TDPSA.

2.2 Property and Ownership Data Is Publicly Available Information

The TDPSA expressly excludes publicly available information from the definition of "personal data." Texas Business & Commerce Code § 541.001(19) provides:

Section 541.001(27) defines "publicly available information" as information that is lawfully made available through government records. All property and property ownership data that Augrented processes is sourced from federal, state, or local government records — including New York City's Department of Buildings, Department of Housing Preservation and Development, and other municipal agencies. This data is lawfully made available to the public by those government bodies.

Because property registration records, ownership filings, building inspection records, and violation histories are all government records made publicly available by law, they fall squarely within the statutory exclusion. The TDPSA does not apply to this category of information regardless of whether a property owner is also a Texas resident.

Section 3: DATA REMOVAL REQUESTS

3.1 No TDPSA Obligation to Remove Property Data

Because Augrented is a small business not subject to Chapter 541's general obligations, and because the property and ownership information Augrented processes constitutes publicly available government records that are expressly excluded from the TDPSA's definition of "personal data," Augrented has no obligation under the TDPSA to remove, delete, or suppress property or ownership data in response to requests from property owners or any other party.

Augrented does not remove property or ownership data in response to TDPSA requests.

3.2 Account Data

The above applies specifically to property and ownership data sourced from government records. If you are a registered Augrented user and wish to delete your personal account information (name, email address, payment details, etc.), you may do so by contacting us at the address below. Account deletion rights are described in our Privacy Policy.

Section 4: SALE AND SHARING OF USER DATA

4.1 Augrented Does Not Sell Personal Data

Augrented does not sell any personal data collected from users as they use the service, including sensitive data. This includes account information, usage data, and any other information that users provide or that is generated through their use of the platform.

4.2 Limited Sharing for Service Delivery Only

Augrented shares user data only to the extent necessary to provide the service. This is limited to third-party providers whose services are integral to platform operation, including:

• Authentication providers — to verify user identity and manage secure login;
• Payment processors — to handle subscription billing;
• Analytics providers — to understand platform usage and improve the service;
• Infrastructure and hosting providers — to store and serve application data.

These providers receive only the data necessary for their specific function and are not permitted to use it for their own marketing or to share it with other parties.

Augrented does not share user data with data brokers, advertisers, or any third party for purposes unrelated to providing the service.
