Rent & eviction protection

Is 817-823 Clement St rent-controlled?

San Francisco's Rent Ordinance caps rent increases and provides eviction protection for most residential units built before 1979 with 2+ units. Here's how this building scores.

Statewide backstop · AB 1482

California Tenant Protection Act of 2019

Even when a building isn't covered by local rent stabilization, the statewide Tenant Protection Act (AB 1482) may still apply. It caps annual rent increases and requires the landlord to state a legal reason to end most tenancies.

Built 1900
Annual rent increase cap
5% + CPI, max 10%
Just-cause eviction
After 12 months
Local rent control likely takes priority. This building appears to fall under the local ordinance above, which is stronger than AB 1482. Where a local just-cause ordinance applies, its rules govern instead of the state cap.

AB 1482 does not apply to single-family homes and condos unless owned by a corporation, REIT, or an LLC with a corporate member; to owner-occupied duplexes; or to deed-restricted affordable housing. The Act is in effect until January 1, 2030. Not legal advice — see the California landlord–tenant guide.

Initial analysis

The 817-823 Clement Street property is a 5-unit, 3-story multi-family residential building constructed in 1900, currently owned by Chan Wing Kwan. The building has undergone significant maintenance and improvements in recent years, with major works including south siding replacement and re-roofing in December 2024 (both issued permits), and comprehensive fire safety system upgrades between 2018-2021. These fire safety improvements included the installation of a fire suppression system in the kitchen hood, addition of fire alarm components, and related electrical and plumbing works. The building successfully completed its mandatory soft-story retrofit program, achieving "Work Complete, CFC Issued" status as a Tier 4 property.

Currently, there are pressing concerns regarding water management systems in the building, with an active complaint filed in December 2024 about significant water leaks affecting ground floor units. The property has experienced multiple sewer-related issues, with several 311 calls regarding sewage backups recorded in May 2023. Historical records show various compliance issues from 2003-2004, including problems with stairs, fire escape maintenance, gas shutoff tools, and heating systems, though these were all eventually abated. The building underwent substantial interior renovations in 2018-2019, including work on a brewpub/restaurant space, which necessitated various utility upgrades and fire safety improvements. Recent permits show ongoing maintenance attention, particularly focusing on building envelope preservation through siding and roofing work, though the water leak issue suggests potential challenges with the building's current water management systems.

What's driving this score

The three data points that most influenced this building's risk rating — ranked by the weight the model placed on each one.

Number of units

The number of units affects how the model reads complaint and violation totals — more units means more potential sources.

DBI tenant complaints (past 7 years)

Formal complaints tenants filed with DBI about this building over 7 years.

Building age

Older buildings tend to have more maintenance challenges; SF's pre-1906 earthquake housing stock carries distinct risk.
