Rent & eviction protection

Is 439-441 11Th Ave rent-controlled?

Statewide backstop · AB 1482

California Tenant Protection Act of 2019

Even when a building isn't covered by local rent stabilization, the statewide Tenant Protection Act (AB 1482) may still apply. It caps annual rent increases and requires the landlord to state a legal reason to end most tenancies.

Built 1927
Annual rent increase cap
5% + CPI, max 10%
Just-cause eviction
After 12 months
Local rent control likely takes priority. This building appears to fall under the local ordinance above, which is stronger than AB 1482. Where a local just-cause ordinance applies, its rules govern instead of the state cap.

AB 1482 does not apply to single-family homes and condos unless owned by a corporation, REIT, or an LLC with a corporate member; to owner-occupied duplexes; or to deed-restricted affordable housing. The Act is in effect until January 1, 2030. Not legal advice — see the California landlord–tenant guide.

Initial analysis

The two-unit residential building at 439-441 11th Avenue in San Francisco's Inner Richmond district is a two-story flats and duplex structure built in 1927, currently owned by Elizabeth Jensen and Pet Sung. The property has undergone several significant renovations in recent years, with the most recent work completed in July 2023 including a bathroom remodel costing approximately $35,732. Prior improvements include substantial kitchen and bathroom renovations in 2019 ($39,783) where electrical systems were brought up to code, and earlier 2018 upgrades that included electrical work with new circuitry installation and the addition of dedicated circuits. The building's maintenance history shows attention to basic infrastructure, with multiple roofing projects documented in 1989 and 2005, though the 2005 permit is now expired.

The property has a history of building violations from January 2002, when multiple issues were documented including mold/mildew on walls, plumbing and electrical violations, and security concerns, though all these violations were abated by February 25, 2002. A recent complaint was filed in November 2024 regarding potentially unpermitted construction work involving cement removal and replacement in the basement/garage area, though this case has been marked as not active. Historical property issues have included reports of inadequate heat, lighting problems in common areas, and appliance concerns, though these appear to have been addressed through subsequent renovations and repairs. The building's more recent history shows consistent maintenance and upgrading of facilities, particularly focusing on modernizing bathrooms and kitchens while addressing electrical infrastructure needs.
