Rent & eviction protection

Is 1375-1377 7Th Ave rent-controlled?

Statewide backstop · AB 1482

California Tenant Protection Act of 2019

Even when a building isn't covered by local rent stabilization, the statewide Tenant Protection Act (AB 1482) may still apply. It caps annual rent increases and requires the landlord to state a legal reason to end most tenancies.

Built 1916
Annual rent increase cap
5% + CPI, max 10%
Just-cause eviction
After 12 months
Local rent control likely takes priority. This building appears to fall under the local ordinance above, which is stronger than AB 1482. Where a local just-cause ordinance applies, its rules govern instead of the state cap.

AB 1482 does not apply to single-family homes and condos unless owned by a corporation, REIT, or an LLC with a corporate member; to owner-occupied duplexes; or to deed-restricted affordable housing. The Act is in effect until January 1, 2030. Not legal advice — see the California landlord–tenant guide.

Initial analysis

The property at 1375-1377 7th Avenue in San Francisco's Inner Sunset neighborhood is a two-story, three-unit multi-family residential building constructed in 1916, currently owned by Susan Run Chan Ho. The building has undergone several significant renovations and repairs over the past 20+ years, with the most recent work in 2024 involving furnace replacement and the installation of an additional gas meter. Notable improvements include a 2013 reroofing project, a substantial 2002 renovation of the third floor involving kitchen and bathroom remodeling and window replacement, and various facade repairs due to dry rot in 2017, which included stucco work and painting.

The building experienced significant maintenance issues in early 2018, when multiple violations were documented through a complaint about mold, which was ultimately resolved by May 2018 following necessary repairs. These violations included concerns about lead paint, fire safety, rodent infestation, and the need for proper permits, all of which were addressed during the remediation process. Since then, the building has generally maintained active upkeep, including plumbing improvements such as a new sewer trap installation and seismic water heater bracing in 2018. Recent infrastructure issues have primarily involved external matters, with multiple reports of parking violations and some tree maintenance concerns in 2023-2024. The property has also experienced periodic complaints regarding garbage receptacle management and sidewalk access, though these are more related to street-level maintenance than building conditions.

There are two broken down sheds in the vacant lot behind jun's beauty salon. they are unsightly and pose a fire hazard. a single match would light a fire down there and it is a threat to the building directly behind it. they should be demolished and removed. my first request seems to have been disregarded.
