Rent & eviction protection

Is 1052-1056 Filbert St rent-controlled?

Statewide backstop · AB 1482

California Tenant Protection Act of 2019

Even when a building isn't covered by local rent stabilization, the statewide Tenant Protection Act (AB 1482) may still apply. It caps annual rent increases and requires the landlord to state a legal reason to end most tenancies.

Built 1908
Annual rent increase cap
5% + CPI, max 10%
Just-cause eviction
After 12 months
Local rent control likely takes priority. This building appears to fall under the local ordinance above, which is stronger than AB 1482. Where a local just-cause ordinance applies, its rules govern instead of the state cap.

AB 1482 does not apply to single-family homes and condos unless owned by a corporation, REIT, or an LLC with a corporate member; to owner-occupied duplexes; or to deed-restricted affordable housing. The Act is in effect until January 1, 2030. Not legal advice — see the California landlord–tenant guide.

Initial analysis

The three-unit, three-story multi-family residential building at 1052-1056 Filbert Street in Russian Hill, owned by Kristina Gavello Marital Trust, has undergone significant renovations since its construction in 1908. In 2014, multiple unauthorized renovations triggered several complaints and violations, including electrical work and plumbing modifications, for which permits were subsequently obtained and proper inspections completed. These improvements included bathroom and kitchen remodels, tankless water heater installations, and various infrastructure upgrades such as replacing galvanized water service lines with copper. More substantial renovations took place in 2015, with the installation of fan coil heating units, a family room addition on both the 1st and 2nd floors, and comprehensive electrical and plumbing work, all properly permitted and inspected.

The most recent significant issues occurred in 2021, when multiple complaints were filed regarding non-functioning windows, heating problems, fire safety concerns, and rodent infestation, though these issues were marked as not active by August 2022. The building's systems have seen substantial upgrades over the years, including multiple tankless water heater installations, comprehensive electrical improvements, and plumbing system updates. Recent complaints from 2023 and 2024 have primarily concerned waste management issues, with multiple reports about toter placement, though these are not directly related to building habitability or safety. The building's permit history shows proper resolution of previous violations, with completed final inspections for multiple permits in 2017, indicating compliance with current building standards.
