Rent & eviction protection

Is 1072-1074 Filbert St rent-controlled?

Statewide backstop · AB 1482

California Tenant Protection Act of 2019

Even when a building isn't covered by local rent stabilization, the statewide Tenant Protection Act (AB 1482) may still apply. It caps annual rent increases and requires the landlord to state a legal reason to end most tenancies.

Built 1914
Annual rent increase cap
5% + CPI, max 10%
Just-cause eviction
After 12 months
Local rent control likely takes priority. This building appears to fall under the local ordinance above, which is stronger than AB 1482. Where a local just-cause ordinance applies, its rules govern instead of the state cap.

AB 1482 does not apply to single-family homes and condos unless owned by a corporation, REIT, or an LLC with a corporate member; to owner-occupied duplexes; or to deed-restricted affordable housing. The Act is in effect until January 1, 2030. Not legal advice — see the California landlord–tenant guide.

Initial analysis

The building at 1072-1074 Filbert Street in Russian Hill is a two-unit, two-story multi-family residential structure built in 1914, currently owned by 2 Jw Investment LLC. The property has undergone numerous alterations and faced several compliance issues over recent years, most notably a series of violations related to unauthorized modifications and safety concerns. In 2019, the building faced significant scrutiny when a citation was issued regarding an unauthorized mezzanine that exceeded permitted size limits, leading to multiple required modifications including a clay tile roof installation and restoration of wood windows to their original design. Recent active complaints from 2024 allege continued work beyond approved permit scopes, including roof deck expansion issues and window modifications, while previous violations from 2019-2021 addressed concerns about retaining wall work and unauthorized story additions that were ultimately abated.

The building has undergone several permitted improvements and repairs, including the installation of a radiant heating system in 2018, an electrical service upgrade in 2019, and various façade improvements. Current building permits show ongoing modifications to the roof deck and ground-level windows to comply with previous enforcement actions. Historical records indicate that the property has had multiple violations and complaints regarding building code compliance, including issues with fire safety systems, window repairs, and illegal modifications, though many of these have been abated or resolved through subsequent permits and repairs. The building's maintenance history shows attention to structural elements such as a concrete retaining wall repair in 2019, but also reveals a pattern of unpermitted modifications that have required subsequent compliance actions. Recent 311 calls from 2024 suggest continued property management activity, including street-related service requests and maintenance issues that have been addressed by relevant authorities.

Violation Address: 1072 Filbert St, San Francisco, CA 94109Assigned DBI Complaint Number: 202654781Description of Violation:I am writing to report a code violation regarding an illegal land-use conversion from residential/storage use to a commercial office space at 1072 Filbert St. This property is located within the RM-1 (Residential - Mixed, Low Density) Zoning District, where commercial office operations are prohibited. The property owner has altered the premises to operate an unpermitted commercial office. The Department of Building Inspection (DBI) Code Enforcement Services (CES) investigated the site under Complaint #202654781. On July 23, 2026, Inspector Thomas Keane confirmed unpermitted structural modifications (specifically, an unpermitted door breached into a garage wall to facilitate this office use) and officially issued a 1st Notice of Violation (NOV) for structural and fire-safety breaches. While DBI handles the physical building code violations, Planning enforcement is urgently required to address the illegal commercial land use. The unpermitted commercial operation disrupts the residential character of our neighborhood. Please coordinate with DBI Inspector Keane (ID 6288) to investigate this illegal conversion and issue a Planning Notice of Violation to halt the unauthorized commercial use of this residential property.
