Rent & eviction protection

Is 725-727 Green St rent-controlled?

San Francisco's Rent Ordinance caps rent increases and provides eviction protection for most residential units built before 1979 with 2+ units. Here's how this building scores.

Statewide backstop · AB 1482

California Tenant Protection Act of 2019

Even when a building isn't covered by local rent stabilization, the statewide Tenant Protection Act (AB 1482) may still apply. It caps annual rent increases and requires the landlord to state a legal reason to end most tenancies.

Built 1908
Annual rent increase cap
5% + CPI, max 10%
Just-cause eviction
After 12 months
Local rent control likely takes priority. This building appears to fall under the local ordinance above, which is stronger than AB 1482. Where a local just-cause ordinance applies, its rules govern instead of the state cap.

AB 1482 does not apply to single-family homes and condos unless owned by a corporation, REIT, or an LLC with a corporate member; to owner-occupied duplexes; or to deed-restricted affordable housing. The Act is in effect until January 1, 2030. Not legal advice — see the California landlord–tenant guide.

Initial analysis

The property at 725-727 Green Street in North Beach is a two-unit, two-story multi-family residential building constructed in 1908 and currently owned by Banaissa Zyad N. The building has experienced recurring maintenance and structural issues over the years, with the most significant recent incident occurring in early 2021 when tenants reported water intrusion, mold concerns, and leaking ceilings following incomplete reroofing work that began in December 2020 and was allegedly abandoned. This roof work, permitted at a cost of $9,475 in 2010, was part of a larger pattern of maintenance challenges that included violations for malfunctioning heating systems, moisture exhaust duct issues, and various interior maintenance problems filed in 2016. The building underwent several significant improvements in 2002, including vinyl siding installation, extensive renovations to a third-floor unit, and window replacements, though some permits from this period expired. The property has a history of electrical and safety concerns, including multiple building violations in 2010 related to damaged walls, floors, electrical systems, and smoke detectors, all of which were eventually abated. A 2016 complaint suggested possible illegal unit modifications in the basement. Recent maintenance activity includes a completed electrical permit from February 2015 for installing a 50-amp receptacle. The building's exterior and common areas have experienced regular street cleaning issues, with multiple 311 calls for garbage and cleaning concerns between 2020 and 2023, though these were generally resolved through inspection and intervention by city services.
