Rent & eviction protection

Is 1819 Golden Gate Ave rent-controlled?

Statewide backstop · AB 1482

California Tenant Protection Act of 2019

Even when a building isn't covered by local rent stabilization, the statewide Tenant Protection Act (AB 1482) may still apply. It caps annual rent increases and requires the landlord to state a legal reason to end most tenancies.

Just-cause eviction
After 12 months
Local rent control likely takes priority. This building appears to fall under the local ordinance above, which is stronger than AB 1482. Where a local just-cause ordinance applies, its rules govern instead of the state cap.

AB 1482 does not apply to single-family homes and condos unless owned by a corporation, REIT, or an LLC with a corporate member; to owner-occupied duplexes; or to deed-restricted affordable housing. The Act is in effect until January 1, 2030. Not legal advice — see the California landlord–tenant guide.

Initial analysis

1819 Golden Gate Avenue is a 16-unit, 3-story multi-family residential building constructed in 1925, currently owned by 1819 Golden Gate I1 LLC. The building has undergone significant improvements and renovations over the past decade, including a $50,000 fire alarm system upgrade in 2023 to comply with current fire code requirements, and numerous unit renovations that typically involved kitchen and bathroom remodels plus washer/dryer installations. Notable recent improvements include work completed in Units 16, 17, and 8 during 2018-2020, and significant electrical upgrades including a new 400-amp service installation in 2015. The building has experienced several maintenance issues in the past, including plumbing problems, interior surface violations, and a historical complaint about construction work done without proper notice in 2015, though all these issues appear to have been resolved.

Of particular note is a 2020 complaint questioning the building's status as a 'soft-story' structure, which could pose seismic safety concerns, though this complaint was marked as not active. The property has maintained a generally active renovation schedule, with multiple units receiving substantial updates throughout the years. The building's fire safety systems have received recent attention, with two fire alarm-related permits completed in 2023. Historical violations from 2003 included issues with security features and fire escape maintenance, but these were subsequently addressed. The property management has also dealt with periodic maintenance issues systematically, as evidenced by the completion of various permits and resolutions to multiple tenant complaints over the years.
