Rent & eviction protection

Is 1278-1280 8Th Ave rent-controlled?

Statewide backstop · AB 1482

California Tenant Protection Act of 2019

Even when a building isn't covered by local rent stabilization, the statewide Tenant Protection Act (AB 1482) may still apply. It caps annual rent increases and requires the landlord to state a legal reason to end most tenancies.

Built 1912
Annual rent increase cap
5% + CPI, max 10%
Just-cause eviction
After 12 months
Local rent control likely takes priority. This building appears to fall under the local ordinance above, which is stronger than AB 1482. Where a local just-cause ordinance applies, its rules govern instead of the state cap.

AB 1482 does not apply to single-family homes and condos unless owned by a corporation, REIT, or an LLC with a corporate member; to owner-occupied duplexes; or to deed-restricted affordable housing. The Act is in effect until January 1, 2030. Not legal advice — see the California landlord–tenant guide.

Initial analysis

The property at 1278-1280 8th Avenue is a three-story, two-unit multi-family residential building located in San Francisco's Inner Sunset neighborhood. Built in 1912 and owned by Jule A. Wong, this flats/duplex structure has undergone several significant improvements over the years. Most notably, in July 2022, a reroofing project costing $12,700 was completed, though this work generated some complaints regarding debris management and dust affecting neighboring properties during the construction period. The building has seen various upgrades and maintenance work, including an interior rear addition in 1998 that added a family room, closet, bath, and storage room. Historical records show earlier improvements such as the installation of a chair lift in 1987 and multiple street space/sidewalk permits in 1989, along with another reroofing project in 1995. There have been two notable plumbing-related complaints on record: a 2003 incident involving water drainage concerns affecting a neighboring backyard that was resolved within three months, and the more recent 2022 complaint regarding roofing work. The building's permit history suggests regular maintenance and improvements have been undertaken, with the most recent being the 2022 reroofing project, which was properly permitted despite initial concerns during its execution.

1278-1280 8th ave --- there is roof working in progress at a private residence at the above location. no permit was found in dbi's website. they are moving debris through a air and light well that is not entirely closed off, and dust and roofing debris are going into neighbor's yards. there is also a pile of debris in the street, and basically no abatement of the debris, which, given the age of the house, may be hazardous.
