Is 4072-4074 24Th St rent-controlled?

Statewide backstop · AB 1482

California Tenant Protection Act of 2019

Even when a building isn't covered by local rent stabilization, the statewide Tenant Protection Act (AB 1482) may still apply. It caps annual rent increases and requires the landlord to state a legal reason to end most tenancies.

Annual rent increase cap
5% + CPI, max 10%
Just-cause eviction
After 12 months
Local rent control likely takes priority. This building appears to fall under the local ordinance above, which is stronger than AB 1482. Where a local just-cause ordinance applies, its rules govern instead of the state cap.

AB 1482 does not apply to single-family homes and condos unless owned by a corporation, REIT, or an LLC with a corporate member; to owner-occupied duplexes; or to deed-restricted affordable housing. The Act is in effect until January 1, 2030. Not legal advice — see the California landlord–tenant guide.

Initial analysis

The 5-unit multi-family residential building at 4072-4074 24th Street in Noe Valley, owned by Carole E Aleo, is a three-story structure built in 1908. The building has undergone several significant improvements and changes over the years, with the most substantial work occurring in 2010-2011 when the property converted office space into a retail music store, complete with ADA upgrades, sound rooms, and new electrical wiring, costing approximately $80,000. During this period, there were some construction-related issues, including complaints about lead paint removal and exceeding the scope of work, though these were resolved by 2012. The building has received regular maintenance and upgrades, including window replacements in 2012 (13 windows with U-factor 0.40), HVAC improvements in 2010 (furnace relocation and new ducts), and various exterior repairs and painting.

The property had some historical concerns in 2005 related to stair repairs and building permits, but these violations were abated by 2008. Recent activity at the property has primarily involved routine external maintenance issues, as evidenced by multiple street cleaning and garbage reports between 2019 and 2024. The most recent complaints include three general cleaning issues (garbage and debris) reported between October 2023 and November 2024, including one instance of "affixed improperly" illegal postings. While there are no active building violations or complaints, and many past issues have been properly resolved, the property has experienced periodic maintenance challenges typical of older buildings, particularly during the 2010-2011 renovation period.
