Rent & eviction protection

Is 1045-1047 Alabama St rent-controlled?

San Francisco's Rent Ordinance caps rent increases and provides eviction protection for most residential units built before 1979 with 2+ units. Here's how this building scores.

Statewide backstop · AB 1482

California Tenant Protection Act of 2019

Even when a building isn't covered by local rent stabilization, the statewide Tenant Protection Act (AB 1482) may still apply. It caps annual rent increases and requires the landlord to state a legal reason to end most tenancies.

15+ years since occupancy
Built 1900
Annual rent increase cap
5% + CPI, max 10%
Just-cause eviction
After 12 months
Local rent control likely takes priority. This building appears to fall under the local ordinance above, which is stronger than AB 1482. Where a local just-cause ordinance applies, its rules govern instead of the state cap.

AB 1482 does not apply to single-family homes and condos unless owned by a corporation, REIT, or an LLC with a corporate member; to owner-occupied duplexes; or to deed-restricted affordable housing. The Act is in effect until January 1, 2030. Not legal advice — see the California landlord–tenant guide.

Initial analysis

The two-unit duplex at 1045-1047 Alabama Street in San Francisco's Inner Mission district is a two-story multi-family residential building constructed in 1900, currently owned by the Raymond M Quan Bypass Trust. The building has undergone several significant maintenance and infrastructure improvements over the years, including a completed plumbing upgrade with a house trap replacement in March 2009, and two notable repairs to the rear wood deck and stairs. In 2016, the property underwent improvements to address dry rot issues with a completed $8,000 project to repair and reinforce the rear wood deck and upgrade the railing to meet current safety codes. A related permit for staircase repairs with an estimated cost of $800 was filed in May 2016 but was subsequently cancelled.

Recent municipal records indicate ongoing parking enforcement issues near the property, with multiple complaints about illegal parking, driveway blocking, and sidewalk violations reported throughout 2024. The building's immediate vicinity has experienced various parking-related incidents, with at least eight parking enforcement actions taken between January 2024 and December 2024. Additionally, there were two notable infrastructure concerns reported in 2024: a blocked driveway incident involving hazardous materials (classified as liquids - oil/paint/other) in January, and an open sidewalk defect case involving tree root damage reported in December 2024. A minor fire alarm incident was recorded, though it was due to a malfunction with no civilian injuries reported. The property's maintenance history suggests regular upkeep of critical infrastructure, though the recurring parking issues in the vicinity represent an ongoing challenge for residents.

DBI Complaint May 11
Property construction has been stalled for months; back yard is a huge trash pile that takes up the entire back yard, and no work has been done in weeks. vines are climbing from abandoned property's back yard onto my property and choking out my plants and pulling off the siding of the neighboring property. i would like owner to contain vines and either clean up back yard or at least let neighbors know of the timeline for restarting work and cleaning up the mess. i have no way to contact new neighbors; the property was sold recently and i have no new contact. workers have been absent so i have not been able to ask them for contact.
