Statewide backstop · AB 1482

California Tenant Protection Act of 2019

Even when a building isn't covered by local rent stabilization, the statewide Tenant Protection Act (AB 1482) may still apply. It caps annual rent increases and requires the landlord to state a legal reason to end most tenancies.

Just-cause eviction
After 12 months
May be covered by AB 1482. The building is old enough for the statewide rent cap (5% + regional CPI, capped at 10% per year) and just-cause protection after 12 months of tenancy.

AB 1482 does not apply to single-family homes and condos unless owned by a corporation, REIT, or an LLC with a corporate member; to owner-occupied duplexes; or to deed-restricted affordable housing. The Act is in effect until January 1, 2030. Not legal advice — see the California landlord–tenant guide.

Initial analysis

The Bayview Preservation LP-owned property at 5 Commerce Court is a multi-family residential complex built in 1976 that has undergone numerous significant maintenance and renovation projects over the years. Most recently, in September 2024, substantial roofing work was initiated for Building 11 and Building 6, with costs of approximately $109,000 and $23,000 respectively. Earlier in 2024, a major interior upgrade project was undertaken for 24 units, valued at $1.6 million, addressing kitchen and bathroom renovations, flooring, and various interior improvements. The building has experienced recurring water-related issues, with multiple complaints and work orders related to plumbing problems between 2022 and 2024, including toilet flooding, water leaks, and mold concerns. Electrical systems have also required attention, with several permits issued between 2007-2019 for various improvements, including panel upgrades, fixture installations, and emergency services. The property had several building violations between 2016-2018, though most were resolved by March 2016, including issues with mold, interior surfaces, electrical systems, and fire safety equipment.

Historical records show that the complex has received various improvements over the years, including significant exterior work in 2007-2008 involving new siding, windows, and ADA accessibility improvements, as well as comprehensive electrical system upgrades in 2007 that included the installation of modern safety features like smoke detectors and arc fault breakers in all units. The building has faced challenges with maintenance response times, as evidenced by multiple complaints regarding delayed repairs and communication issues, particularly regarding water-related problems. While many past violations and complaints have been resolved, the recurring nature of plumbing and maintenance issues suggests ongoing challenges with property upkeep and response times.
