Rent & eviction protection

Is 2434-2436 Bay Shore Blvd rent-controlled?

Statewide backstop · AB 1482

California Tenant Protection Act of 2019

Even when a building isn't covered by local rent stabilization, the statewide Tenant Protection Act (AB 1482) may still apply. It caps annual rent increases and requires the landlord to state a legal reason to end most tenancies.

Annual rent increase cap
5% + CPI, max 10%
Just-cause eviction
After 12 months
Local rent control likely takes priority. This building appears to fall under the local ordinance above, which is stronger than AB 1482. Where a local just-cause ordinance applies, its rules govern instead of the state cap.

AB 1482 does not apply to single-family homes and condos unless owned by a corporation, REIT, or an LLC with a corporate member; to owner-occupied duplexes; or to deed-restricted affordable housing. The Act is in effect until January 1, 2030. Not legal advice — see the California landlord–tenant guide.

Initial analysis

The property at 2434-2436 Bay Shore Boulevard is a two-story mixed-use building constructed in 1925, containing two residential units above ground-level commercial space. The building has undergone several significant modifications and faced multiple compliance issues over the years. Most notably, between 1999-2000, there was a major enforcement action regarding unauthorized conversions and occupancy violations, where the ground floor commercial space was found to contain illegal residential units with multiple safety concerns including inadequate fire protection, improper egress, and lack of smoke detectors. These violations were formally abated in December 2000.

More recent issues have centered around maintenance concerns, particularly regarding the roof. In 2024-2025, there were multiple complaints about falling roof tiles, including safety hazards affecting pedestrians. The building underwent various structural work in the 1990s, including fire damage repairs (1998), dry rot repairs (2005), and an electrical service upgrade (2003). There have been multiple citations for unauthorized construction, including an 18'x22' carport cover and a 14'x12' shed, though these violations were eventually abated. The property has a history of parking-related complaints and some recent graffiti issues. Notably, a 2024 complaint remains open regarding potential roof problems that may impact neighboring properties. While there have been several fire safety-related complaints between 2018-2024, all were found to have no merit upon investigation.

Date last observed: 01-jan-25; time last observed: 4:30pm; identity of person performing the work: none; floor: roof; unit: mix buildi; exact location: roof; building type: both other building; ; additional information: after closing out our complaint case #202431559 regarding tenant concern on falling roof tile, i i believe the roof issue may be related to the neighbor's building at 2434-2436 bayshore blvd, san francisco, ca 94134. from my own observation, there appears to be a missing tile on the roof that faces the direction of our building and commercial entrance. this could explain why the issue is affecting the storefront area and may be causing concern for the store manager. given these observations, i would like to formally request that the neighboring property’s roof be inspected as well, as it seems to be in a concerning condition that may be impacting both our building and the commercial tenant below.;
